On September 3, 2015, near Paw Paw, Michigan, a 72-year old Illinois man was killed when an "inattentive" truck driver failed to slow down as he was approaching traffic that was building up in a construction zone.  As a result of the truck driver's failure to stop or slow down, the truck crashed into the rear of a Toyota SUV that was driven by the Illinois man.  The tragic accident occurred on I-94. 

Michigan State Police Lieutenant Dale Hinz was quoted by the WWMT-TV Newschannel 3 as saying, "90% of traffic crashes are a result of of driver behavior.  The takeaway from today's crash is you have to pay attention, you have to be ready especially during the summer months for lane closures and backups...unfortunately in this case we can see the results of when driver unattention comes into play."

In this accident, it seems clear that there is driver inattention at play; however, there may be multiple parties liable for causing this man's unfortunate wrongful death.  Not only should a thorough investigation of the circumstances involving the driver be undertaken, but the design of the construction zone as well.  The days immediately following an accident of this nature consist of information gathering.  If a family feels that their loved one died wrongfully, they should retain an attorney who is experienced in obtaining the necessary court orders and retained experts.  There is extensive evidence to be preserved and gathered in the early stages of litigation.
